Anthony B. Bingham Selected to State Bar Fee Arbitration Committee
Anthony B. Bingham has been selected to the 2014 – 2015 Arizona State Bar Fee Arbitration Committee. This committee is comprised of 60 or more volunteers who are members of the State Bar. The free, voluntary Fee Arbitration Program is designed to resolve fee disputes over $500.00 between bar members and their clients. Under certain circumstances, the disputes are between bar members. As a member of the Fee Arbitration Committee, Tony will oversee, review, and appoint fee arbitrators to hear cases and will also often serve as the arbitrator himself. The decisions of the arbitrator(s) are final and binding, and are subject to only limited appeal through the superior court system under the Arizona Revised Statutes.

Police Must Typically Have A Search Warrant to Draw Blood Without Your Consent In a DUI/DWI Investigation
The U.S. Supreme Court held that in routine DUI/DWI cases the police must obtain a search warrant before taking the suspect’s blood when the suspect refuses to consent to a blood draw. The suspect was stopped by police for speeding and repeatedly crossing the centerline. The suspect performed poorly on field sobriety tests and declined to submit to a portable breath-test device to measure his blood alcohol concentration (BAC). The police officer transported the suspect to a hospital where the officer advised the suspect that under state law he was required to voluntarily submit to a blood test. The suspect was also told that under the state’s implied consent law, if he refused to submit to the blood test his driver’s license would be revoked. The suspect still refused to voluntarily submit to a blood test. The police officer never obtained a search warrant for the suspect’s blood before directing a lab technician to draw blood from the suspect. The lab test result indicated the suspect’s BAC was .154 percent, above the state’s legal limit of .08 percent. The U.S. Supreme Court upheld the lower court’s suppression of the suspect’s blood test result on the basis that the suspect’s Fourth Amendment rights were violated. The Supreme Court wrote the Fourth Amendment requires police during DUI/DWI investigations to obtain a search warrant before blood can be drawn from a suspect without their consent unless there is an urgent reason for drawing the blood without a warrant.

Why Smart People Fall For Investment Scams
An October 20, 2014 online Forbes article discusses the various reasons people fall victim to investment fraud. Knowledge, trust and opportunity (or lack thereof) are all common factors of fraud victims.
“There are many reasons why we fall for investment scams. As we understand and realize these factors, we are less likely to fall prey to investment scamsters — who we call “financial serial killers.”
According to the article, the best ways to protect yourself include; look objectively at qualifications, don’t make decisions based on emotion, and don’t be lured by “scarcity of the opportunity.” The article also includes seven questions you to ask. Victim of Fraud?
A recent Fraud Watch Alert by AARP reports that too many people who have been scammed out of their hard-earned money, suffer their losses alone and in silence. Fraud is a widely underreported crime and therefore the perpetrators go unpunished and continue to scam others.
“If you’ve been scammed, it can be deeply embarrassing, and make you question your judgment,” said AARP Illinois State Director Bob Gallo. “But even if you feel that the losses are not large enough to report, or that nothing will result from filing a report, you should report it as this will help protect others from becoming victims.”
